Home Depot Worker Killed in Delivery Truck Accident

Nobody wants to be injured or killed while at work, but sometimes accidents happen. Unfortunately, these accidents can be serious and even deadly.

A man was recently killed in a workplace accident at a New Jersey Home Depot. The 38-year-old employee was hit by a delivery truck. The fatal crash happened on the morning of February 18.

The incident happened at a Home Depot warehouse in Perth Amboy on Riverview Drive. The man died at the accident scene. The driver of the delivery truck stopped and talked to the police. It is unknown if they will face any changes.

The Occupational Safety and Health Administration (OSHA) is investigating the accident.

Home Depot did not comment on the matter. However, the Perth Amboy police chief extended his condolences to the victim’s family, friends, and coworkers during this difficult time.

What Happens After a Workplace Death in New Jersey?

When an employees dies in a workplace accident, here is what typically happens:

  • Immediate response and reporting. The first priority is emergency response and securing the scene. Employers must:
    • Call emergency services.
    • Secure the area to prevent further harm.
    • Begin an internal incident report.

They are also legally required to report the death to OSHA within eight hours of learning about it. This reporting often triggers a federal OSHA investigation, especially if safety violations may have contributed to the death.

  • OSHA investigation. After notification, OSHA may:
    • Inspect the worksite.
    • Interview employees and supervisors.
    • Review safety records and equipment.

If violations are found, the employer can face citations, fines, or required safety changes.

  • Workers’ compensation claim begins. In New Jersey, workplace deaths are handled primarily through the workers’ compensation system. It is a no-fault system, which means benefits are available regardless of who caused the accident. The employer must file a First Report of Injury with the state, starting the claim process.

Beyond OSHA, other investigations may occur:

  • Employer internal safety review
  • Insurance company investigation
  • Law enforcement (if negligence or criminal conduct is suspected)

While workers’ compensation is the primary remedy, additional legal action may be possible. If someone other than the employer contributed to the death (such as equipment manufacturer and contractor), the family may file a civil lawsuit for damages.

A wrongful death claim may be possible. These claims can seek compensation for:

  • Lost income.
  • Loss of companionship.
  • Medical expenses before death.

However, lawsuits against the employer directly are usually barred unless there was intentional wrongdoing.
