New Jersey Man Files Slip and Fall Lawsuit Against Walmart for $2 Million

A New Jersey man who was injured in a slip and fall accident in Walmart last summer has turned down a $75,000 settlement offer from the store. Instead, he and his lawyer will be filing a federal lawsuit for $2 million.
The Jersey City man was picking up supplies for his employer on the afternoon of July 26, 2024, at a New York Walmart. While shopping, he slipped on a wet spot and suffered serious injuries to his back and spine. The treatment required lumbar fusion surgery.
The lawsuit was first initiated in Hudson County Superior Court in April, but a notice filed in May asks to have the matter heard in federal court, since the damages exceed $75,000.
According to the lawsuit, the man lost his balance after stepping in a “manhole-sized puddle of light brown liquid substance” that was near the self-checkout area toward the front of the store.
On April 30, five days after Walmart was served with the lawsuit, the store’s lawyers reached out with a settlement letter. The letter offered the man $75,000 if he signs a document stipulating that his damages are less than $75,000, exclusive of interest and court costs.
However, the man and his lawyer turned down the stipulated offer. They claim they cannot agree to it, as the man’s damages exceed $75,000.
According to the notice filed in federal court on May 16, the man is suing Walmart for $2 million.
The man alleges he suffered severe, grievous, and permanent injuries. He also had pre-existing injuries that were exacerbated due to the fall. In his lawsuit, he is also alleging gross negligence and claims the store failed to maintain and upkeep the premises to prevent injuries to customers and employees.
The complaint is the second personal injury lawsuit filed against Walmart by a New Jersey resident in the past year. In June 2024, a 67-year-old woman from Burlington County sued a Walmart store in Marlton. She claimed she was hit by a restocking cart filled with Nabisco and Mondelēz International products. That lawsuit is pending in state court.
