Two kinds of premises liability
Property owners are responsible for safe conditions in two ways. First, the design and use of their property can not be inherently dangerous. Parking ramps, for instance, are often the sites of assaults and serious injuries from falls. Ramp owners are required to ensure that sufficient lighting and security exists to safeguard the public.
In the second instance of liability, property owners must attend quickly to remove hazards that may arise in the course of normal operations. This relates to cleaning up spilled liquids and removing ice and snow from an overnight snowstorm. The property owner is given a reasonable amount of time to remove the danger, after being notified of it.
Construction accidents, falling accidents and other injuries on the job
Employers, too, have a responsibility to ensure that the work environment is safe for employees. This includes adhering to regulations governing chemical spills and environmental hazards including noise restrictions and lighting requirements. If you have suffered a work-related injury, you may be entitled to recover damages in excess of workers' compensation.
